General terms and conditions for accommodation services
Preamble
The "fermedugolf.com" website is published by Société Française des Hôtels de Montagne SFHM, a public limited company with capital of 28,975,000 euros, whose registered office is at 47, rue du Faubourg Saint-Honoré 75008 Paris, registered with the Paris Trade and Companies Register under number 562 134 510, and whose intra-community VAT number is FR 51 562 134 510, and the insurer, AXA France IARDSA, 313 terrasse de l'Arche, 92727 Nanterre Cedex.
On this website, the Société Française des Hôtels de Montagne SFHM sells accommodation services at the Hotel La Ferme du Golf.
These General Terms and Conditions of Accommodation (hereinafter referred to as the "General Terms and Conditions") apply to all reservations for rooms at the Hotel La Ferme du Golf made on the website "fermedugolf.com" (hereinafter referred to as the "Website") (hereinafter referred to as the "Online Reservation") or directly with the Hotel La Ferme du Golf (hereinafter referred to as the "Live Reservation") by consumers, as defined in the introductory article of the French Consumer Code (hereinafter referred to as the "Client(s)").
The Customer declares that he/she has read the General Conditions before making a reservation. Validation of a booking therefore implies acceptance of the General Terms and Conditions without restriction or reservation.
The Customer declares that he/she has full legal capacity to enter into a contract enabling him/her to commit to the General Terms and Conditions.
Article 1 - Purpose
The General Terms and Conditions define the rights and obligations of the parties in the context of online or direct reservations of rooms in the La Ferme du Golf hotel.
Article 2 - Scope of application
The General Terms and Conditions apply to any reservation of a room at the Hotel La Ferme du Golf, made on the Website or directly with the Hotel La Ferme du Golf, by a Client.
The Client must confirm his/her agreement to all of the General Terms and Conditions by ticking a box provided for this purpose on the reservation form on the Website prior to validating his/her reservation for an online reservation, or by validating the transaction for a direct reservation.
In accordance with the provisions of article 1127-1 of the French Civil Code, the General Terms and Conditions may be kept by the Customer by means of a computer record and may also be reproduced by means of a printout.
The General Terms and Conditions apply for as long as they are available on the Website. They may be amended from time to time. The applicable conditions are those in force on the Website at the time of booking. The date on which the General Terms and Conditions are posted online is the date on which the General Terms and Conditions come into force.
Article 3 - Booking procedure
The online booking procedure comprises the following steps:
- Selecting the booking form (which is available in several languages): you can choose the language and currency you prefer;
- Entering the dates of your stay, the number of nights, the number of rooms and the number of people on the booking form;
- Consult and select the room(s) from our offers. Please note that in the event of prolonged inactivity during the booking procedure, it is possible that the accommodation offer selected will no longer be guaranteed. In this case, a message indicating "session expired" will be displayed and the Customer will have to restart the booking procedure from the beginning;
- Checking the summary of the offer chosen: the Customer has the opportunity to check the details of the offer chosen, in particular the total price and the booking and cancellation conditions, before finalising the booking;
- Entry of personal details and bank details. Possibility of creating/using a user account, although creating an account is optional;
- Bank details are recorded as a guarantee in order to validate the booking and for the payment of the deposit, which is made at the time of booking. Your card may also be pre-authorised or debited at a later date in accordance with the provisions set out below in article 7 "Payment conditions";
- The Customer acknowledges having read and accepted the General Terms and Conditions by ticking the box provided for this purpose, prior to validating his/her reservation. The Customer also accepts the personal data protection and cookie use policy of Hotel la Ferme du Golf by ticking the appropriate box.
- Booking validation. Validation entails an obligation to pay in accordance with the provisions set out below in article 7 "Payment conditions", unless special conditions are specified in the offer and at the time of payment.
The online booking procedure involves the following steps:
- Receipt of an email from the Ferme du Golf hotel, with a summary of the holiday offer (date, room, total amount, insurance, etc.) and payment link. Please note that the payment link is accessible for a limited time, as stated in the email. After this period, the payment link will expire and the Customer's booking option will be automatically cancelled.
- By clicking on the payment link, the Customer agrees to accept the general terms and conditions of sale attached to the holiday proposal and available on the fermedugolf.com website.
- By clicking on the payment link, the Customer is redirected to a payment platform and asked to enter their personal details and bank details.
- Direct debit is made directly via the pay system;
Article 4 - Acknowledgement of receipt of the reservation
Once the Customer has validated their booking, they will receive a summary confirmation of their booking electronically.
Article 5 - Booking and cancellation conditions
Below are the booking and cancellation conditions, which depend on the offer chosen and/or available at the time of booking.
The Customer may only choose available offers, proposed on the site or directly at the time of booking, to the exclusion of all offers described below, but not available at the time of booking. Booking and cancellation conditions different from those set out in this article may be provided for our special offers and rates. These conditions will then be specified in the details of the offer and when the booking is confirmed.
Article 5.1 - Booking and cancellation conditions
- Standard rate
At the time of booking, the Client pays a deposit corresponding to 30% of the total price of the stay, including breakfast, taxes and service charges, but excluding tourist tax.
The Customer pays the balance of the price to the hotel during the stay.
Any cancellation of the reservation must be notified before 6 p.m. (Megève local time) to the following number +33 4 50 21 14 62 and/or by email to contact@fermedugolf.com , at the latest 30 days before the planned date of arrival. If these conditions are met, the Customer will be refunded the deposit paid to guarantee the reservation.
In the event of cancellation less than thirty days before the date of arrival, the deposit will be forfeited by the Customer and retained by the Société Française des Hôtels de Montagne SFHM.
In the event of cancellation of the stay on the same day, during the stay, and/or in the event of no-show by the Client, the full amount of the reservation - including the deposit and the balance of the price - will be due and invoiced.
- Last-Minute Offer
At the time of booking, the Customer pays the total cost of their stay, including breakfast, taxes and service charges, but excluding tourist tax.
The stay cannot be cancelled, modified or reimbursed. In the event of cancellation or modification, the total amount of the stay deducted cannot be refunded.
- Comfort Offer
At the time of booking, the Customer pays a deposit corresponding to 30% of the total price of the stay, including breakfast, taxes and service charges, but excluding tourist tax.
The Customer pays the balance of the price to the hotel during the stay.
Any cancellation of the reservation must be notified before 6 p.m. (Megève local time) to the following number +33 4 50 21 14 62 and/or by email to contact@fermedugolf.com , at the latest 14 days before the planned date of arrival. If these conditions are met, the Customer will be refunded the deposit paid to guarantee the reservation.
In the event of cancellation less than 14 days before the date of arrival, the deposit will be forfeited by the Customer and retained by the Société Française des Hôtels de Montagne SFHM.
In the event of cancellation of the holiday on the same day, during the stay, and/or in the event of no-show by the Customer, the full amount of the reservation - including the deposit and the balance of the price - will be due and invoiced.
- Flexible Offer
At the time of booking, the Customer pays a deposit corresponding to 30% of the total price of the stay, including breakfast, taxes and service charges, but excluding tourist tax.
The Customer pays the balance of the price to the hotel during the stay.
Any cancellation of the reservation must be notified before 6 p.m. (Megève local time) to the following number +33 4 50 21 14 62 and/or by email to contact@fermedugolf.com , at the latest 7 days before the planned date of arrival. If these conditions are met, the Customer will be refunded the deposit paid to guarantee the reservation.
In the event of cancellation less than 7 days before the date of arrival, the deposit will be forfeited by the Customer and retained by the Société Française des Hôtels de Montagne SFHM.
In the event of cancellation of the stay on the same day, during the stay, and/or in the event of no-show by the Client, the full amount of the reservation - including the deposit and the balance of the price - will be due and invoiced.
Article 5.2 - No right of withdrawal
The Customer, excluding any professional Customer, is reminded that, in accordance with article L. 221-28, 12° of the French Consumer Code, he/she does not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code.
Article 5.3- Changes to the booking
Any change to the booking must be notified before 6 p.m. (Megève local time) to the following number +33 4 50 21 14 62 and/or by email to contact@fermedugolf.com , at the latest:
- 30 days before the date of arrival for the Standard Offer ;
- 14 days before the date of arrival for the Comfort Offer;
- 7 days before the date of arrival for the Flexible Offer;
Changes will be accepted at the discretion of the Société Française des Hôtels de Montagne SFHM, subject to room availability.
In the event that the stay is shortened or postponed due to the Customer and this :
- Less than 30 days before the date of arrival for the Standard Offer ;
- Less than 14 days before the date of arrival for the Comfort Offer;
- Less than 7 days before the date of arrival for the Flexible Offer;
the Société Française des Hôtels de Montagne SFHM will retain the amount of the deposit paid as compensation in the event that it has not succeeded in reselling the room to another customer.
Light and Last Minute Offers cannot be modified. In the event of a change, the total amount of the stay charged will not be refunded.
Whatever the offer, in the event of no-show, modification or cancellation on the same day or during the stay, the Société Française des Hôtels de Montage will invoice the customer for the total amount of the stay, including the deposit and the balance of the price.
Article 6 - Prices
The price shown includes only the room reservation and breakfast, to the exclusion of any additional services (ski passes, catering, etc.) which will be reserved and invoiced separately.
The room/night price does not include tourist tax in the chosen currency.
Tourist tax is payable in addition on site. It is indicated on the booking form when the booking is recapitulated.
Article 7 - Terms of payment
The Client provides his/her bank details for the payment of the deposit, except in the case of special conditions or rates, by credit or debit card (Visa, Mastercard or American Express only) - VAD system - by indicating the card number directly in the area provided for this purpose, as well as its date of validity (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram.
On the day of arrival at the hotel La Ferme du Golf, the Customer must present the bank card used to guarantee the reservation or make the payment. The Client may also be asked to provide proof of identity in order to prevent credit card fraud.
The customer authorises the hotel to debit his/her bank card for the payment of the deposit at the time of booking.
The balance of the price must be paid :
- at the hotel during the stay by bank card (EMV system), or cheque, or in cash within the limits specified by legal provisions,
- with the exception of special offers and rates which provide for prepayment of the full price at the time of booking by credit card used to guarantee the reservation.
Article 8 - Conditions of stay
On arrival at the Hotel La Ferme du Golf, the Customer will be asked to show proof of identity and, where applicable, to complete a police form, in accordance with article R.611-42 of the Code de l'Entrée et du Séjour des Etrangers et du Droit d'Asile (CESEDA).
The personal data collected under the police form is kept for a period of six months. This data is collected for the purposes of preventing public order disturbances, legal investigations and research in the interests of individuals. In this context, the data may be passed on to police and gendarmerie units at their request.
Rooms must be vacated by 11am.
We will do our utmost to ensure that rooms are ready as soon as possible. However, they will only be available from 4pm.

With regard to pets, dogs and cats are welcome, with the exception of the dangerous breeds listed by law. A supplement of €20 per animal per day will be charged (food not included).
Article 9 - Warranties
Hôtel La Ferme du Golf guarantees the conformity of its services under the conditions set out in Articles L. 411-1 et seq. of the French Consumer Code.
Article 10 - Liability
Although the Société Française des Hôtels de Montagne SFHM makes every effort to ensure that the photographs and descriptions on the Website or included in the offer of a stay at the Hôtel de la Ferme du Golf reflect as accurately as possible the accommodation services offered, these photographs and descriptions are not contractually binding. Variations may occur, for example, in the event of renovation or change of furnishings. The Société Française des Hôtels de Montagne cannot be held responsible for minor variations.
The Société Française des Hôtels de Montagne SFHM may not be held liable for the non-execution or improper execution of the reservation in the event of force majeure, the fault of a third party, the fault of a partner of the Société Française des Hôtels de Montagne SFHM, the fault of the Customer, and in particular in the event of the unavailability of the Internet network, the impossibility of accessing the Website or the payment link, external intrusion or computer viruses.
Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for any reason attributable to the Customer will result in the cancellation of the reservation at the Customer's expense, without prejudice to any civil or criminal action against the Customer.
The Société Française des Hôtels de Montagne SFHM declines all responsibility in the event of theft, loss or damage to belongings belonging to Customers during their stay.
Article 11 - Complaints/Customer service
For any information or complaint relating to the General Terms and Conditions or to accommodation services, Customers should contact the Customer Service Department of Société Française des Hôtels de Montagne SFHM on +33 4 50 21 14 62 and/or by e-mail at contact@fermedugolf.com , quoting their reservation number where applicable.
Article 12 - Relocation
In the event of an exceptional event or the impossibility of making the reserved room available to the Customer, or in the event of force majeure, Hotel La Ferme du Golf may offer the Customer accommodation in a hotel of at least an equivalent category, or if it is of a lower category, a room of a higher standard than that originally reserved, for services of the same nature. The Société Française des Hôtels de Montagne (SFHM) will pay any additional costs incurred as a result of this relocation, for services of the same nature, and will not be liable for any additional compensation whatsoever.
In the exceptional event that the hotel cannot find an equivalent alternative accommodation solution as indicated above, and except in cases of force majeure, the Société Française des Hôtels de Montagne SFHM may cancel the reservation and return to the customer double the deposit and the balance of the price if the latter has already been paid.
Article 13 - Respect for privacy - personal data
With regard to the Société Française des Hôtels de Montagne SFHM's compliance with the regulations in force concerning the protection of personal data in the context of the collection and processing of customers' personal data collected in the reservation form, we refer you to the "Policy on the protection of personal data and the use of cookies of the hotel La Ferme du Golf .
In addition, in accordance with article L.223-1 of the French Consumer Code, the Customer may register on a BLOCTEL telephone anti-solicitation list.
Article 14 - Intellectual property rights
The reproduction of any of the elements making up the La Ferme du Golf hotel offers present on the Website or in the proposal for a stay at the La Ferme du Golf hotel for information purposes (for example by printing a page containing the details of an offer) is authorized provided that it is for strictly personal and private use.
However, any reproduction and, in general, any use of copies of elements of the La Ferme du Golf hotel offers present on the Website, or in the proposal for a stay at the La Ferme du Golf hotel made for other purposes are strictly forbidden, except with the prior written consent of the Société Française des Hôtels de Montagne SFHM.
With regard to the intellectual property rights held by the Société Française des Hôtels de Montagne SFHM on the elements of the Website, we refer you to the provisions of Article 3 entitled "Intellectual Property Rights" of the General Terms and Conditions of Use of the Website.
Article 15 - Force majeure
The performance by Société Française des Hôtels de Montagne SFHM of all or part of its obligations shall be suspended in the event of the occurrence of a case of force majeure which would hinder or delay the performance thereof.
Force majeure is defined as any event beyond the control of Société Française des Hôtels de Montagne SFHM, which could not reasonably have been foreseen at the time of booking and the effects of which cannot be avoided by appropriate measures, in accordance with article 1218 of the French Civil Code.
The following are considered as such and without the Parties having to establish the characteristics defined in article 1218 of the Civil Code: terrorism, riots, insurrection, social unrest, strikes of any kind, machinery breakdown, sinking, supply disruptions for any reason whatsoever, shortages of raw materials, epidemics and pandemics, as well as any measures taken by the competent authorities to limit the spread of an epidemic or pandemic, whether or not in the context of a declaration of a state of health emergency.
Société Française des Hôtels de Montagne SFHM will inform the Customer of the occurrence of a case of force majeure within eight (8) days of its occurrence. If the suspension of obligations continues for more than fifteen (15) days, the Customer or Société Française des Hôtels de Montagne SFHM will have the option of cancelling the current reservation, in which case the Customer will be reimbursed.
Article 16 - Agreement of proof
The entry of the required banking information, as well as the acceptance of the General Conditions and the validation of the reservation, constitute the acceptance of the hotel contract, between the parties, having the same value as a handwritten signature.
Article 17 - Applicable law - Dispute resolution - Mediation
The General Reservation Conditions are governed by French law.
In the event of a dispute, the French version of the reservation form shall prevail.
In the event of any dispute relating to these General Terms and Conditions, or any dispute arising therefrom, the Customer must send a written complaint to the Société Française des Hôtels de Montagne SFHM Customer Service Department by registered post with acknowledgement of receipt to the following address: 47 rue du Faubourg Saint-Honoré, 75008 Paris.
In the event of no response to the request for a complaint, or in the event of failure to resolve the complaint within three (3) months of the date of receipt, the Customer may refer the matter free of charge to the consumer ombudsman for Société Française des Hôtels de Montagne SFHM, namely the Association of European Ombudsmen (AME CONSO), within one year of the written complaint sent to Société Française des Hôtels de Montagne SFHM.
The consumer ombudsman may be contacted :
- either by completing the appropriate form on the AME CONSO website: www.mediationconso-ame.com ;
- or by post to AME CONSO, 11 Place Dauphine - 75001 PARIS.
The mediator will attempt, independently and impartially, to bring the parties together with a view to finding an amicable solution, in accordance with articles L. 611-1 et seq. of the French Consumer Code. The customer remains free to initiate, accept or refuse recourse to mediation. In the event of recourse to mediation, the parties remain free to accept or refuse the solution proposed by the mediator.
Should mediation or any other form of out-of-court settlement fail, the dispute will be submitted to the jurisdiction of the competent French courts designated in accordance with French procedural rules.
